The Memory Care Pharmacist respects your privacy and is committed to the responsible management of personal information. This Privacy Policy explains how personal information is collected, used, disclosed, retained, protected, and otherwise handled in connection with the website located at https://thememorycarepharmacist.com (the “Website”), associated downloadable resources, and related communications.
This Privacy Policy is intended to reflect applicable Canadian private-sector privacy requirements, including the Personal Information Protection and Electronic Documents Act (“PIPEDA”), where applicable, together with other privacy and electronic-communications laws that may apply to our activities. The particular law that applies may depend on the nature of the activity, the location of the individual, and the jurisdiction in which personal information is processed.

This Privacy Policy does not govern the privacy practices of third parties that operate independently from The Memory Care Pharmacist, including Amazon, MailerLite, Carrd, Cloudflare, Google, social-media platforms, or other external websites and service providers. Those organizations maintain their own privacy policies and are responsible for their own practices, subject to applicable law.

2. Definitions

For the purposes of this Privacy Policy:
“Personal Information” means information about an identifiable individual, or information that can reasonably be linked to an identifiable individual, as defined under applicable privacy legislation. Depending on the circumstances, Personal Information may include a name, email address, Internet Protocol address, correspondence, online identifiers, or other identifying information.
“Service Provider” means an organization that processes information or provides services on our behalf, including website hosting, content delivery, security, email distribution, analytics, file storage, and related technology services.
“The Memory Care Pharmacist,” “we,” “us,” and “our” refer to the operator of the Website.
“Visitor,” “you,” and “your” refer to an individual who accesses the Website or otherwise interacts with us.

3. Identity and Accountability

The Memory Care Pharmacist is an educational website created and operated by Rob Schell, a Canadian pharmacist with more than thirty years of professional experience working with older adults. The Website provides educational information and resources concerning brain health, dementia education, caregiver support, healthy aging, accessible activities, and Memory Care Puzzle Books.
The Memory Care Pharmacist is responsible for Personal Information under its control. A Privacy Officer has been designated to oversee privacy practices, respond to privacy enquiries and requests, and address concerns regarding compliance with this Privacy Policy and applicable privacy requirements.
Privacy-related communications may be directed to the contact information set out in Section 27.

4. Privacy Principles

Our privacy practices are guided by the following principles:
• Accountability: we accept responsibility for Personal Information under our control;
• Purpose limitation: we identify the purposes for which Personal Information is collected before or at the time of collection;
• Meaningful consent: where consent is required, we seek consent in a manner appropriate to the circumstances and sensitivity of the information;

• Safeguards: reasonable safeguards are used to protect Personal Information in a manner proportionate to its sensitivity;
• Openness: information about our privacy practices is made available through this Privacy Policy;
• Individual access: individuals may request access to and correction of their Personal Information, subject to legal limitations; and
• Challenging compliance: individuals may raise privacy concerns with the Privacy Officer.

5. Consent and Choice

Where consent is required by applicable law, we will seek meaningful consent before or at the time Personal Information is collected, or before it is used or disclosed for a new purpose. The form of consent may be express or implied, depending on the sensitivity of the information, the reasonable expectations of the individual, and the circumstances permitted by law.
We do not require an individual to consent to the collection, use, or disclosure of Personal Information beyond what is reasonably necessary to provide a requested resource or service. Where an optional use is not necessary to fulfil the individual’s request, we will seek a separate choice where required.
You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawal may affect our ability to provide a requested resource or communication. Instructions for withdrawing consent are set out in Sections 8 and 22.

6. Personal Information We Collect

6.1 Information You Provide VoluntarilyYou may provide Personal Information when you request free puzzle samples, subscribe to email communications, submit a contact form, send an email, provide feedback, or otherwise communicate with us. Depending on the interaction, this may include:
• your first name;
• your email address;
• your communication and subscription preferences;
• the contents of an enquiry, comment, or message; and
• any other information you choose to provide.
Providing Personal Information is voluntary. However, if information required to fulfil a request is not provided, we may be unable to deliver the requested resource or respond to the enquiry.6.2 Information Collected AutomaticallyWhen you access the Website, certain technical and usage information may be collected automatically through server logs, cookies, analytics tools, security technologies, or similar mechanisms. Depending on the Website configuration and services in use, this information may include:

We do not intentionally use this technical information to identify an individual by name. However, certain technical information, including an Internet Protocol address or persistent identifier, may constitute Personal Information under applicable law.6.3 Sensitive Information and Health InformationThe Website is not intended to collect personal health records, prescription records, medical charts, government identification numbers, payment-card information, or other highly sensitive Personal Information. Please do not submit detailed medical histories, medication lists, diagnoses, or other sensitive information through general contact forms or email unless it is reasonably necessary for your enquiry and you understand the risks associated with electronic communications.
Information submitted through the Website does not establish a pharmacist-patient, healthcare-provider, or other professional relationship.6.4 Information Received from Third PartiesWe may receive limited information from Service Providers, such as confirmation of a subscription, delivery status, email engagement information, aggregate analytics, security alerts, or referral information. We do not receive payment-card information from Amazon in connection with book purchases made through Amazon.

7. Purposes for Collection, Use, and Disclosure

Subject to applicable law, Personal Information may be collected, used, or disclosed for the following purposes:
• to provide free puzzle samples, educational downloads, or other resources requested by you;
• to administer subscriptions and send communications you have agreed or are otherwise legally permitted to receive;
• to respond to enquiries, requests, comments, or accessibility concerns;
• to operate, maintain, secure, troubleshoot, and improve the Website;
• to understand Website use and determine which content and resources are most useful;
• to improve accessibility, performance, design, and visitor experience;
• to develop new educational content, puzzle resources, books, and related services;
• to detect, investigate, prevent, or respond to fraud, abuse, security incidents, unlawful activity, or technical problems;
• to comply with legal, regulatory, tax, recordkeeping, or contractual obligations;
• to establish, exercise, or defend legal rights; and
• for any other appropriate purpose disclosed at or before the time of collection, or for which consent is obtained.
We will not use Personal Information for a materially different purpose without providing notice and obtaining any consent required by applicable law.

8. Email Communications and Canada’s Anti-Spam Legislation

If you subscribe to our mailing list, request a resource through a form that clearly includes email consent, or otherwise consent to receive communications, we may send educational articles, caregiver resources, brain-health information, updates about puzzle books, Website announcements, and occasional promotional communications concerning our own products or services.
Requesting a free resource does not, by itself, authorize ongoing marketing communications unless the form and accompanying notice clearly state that such communications will be sent and the required consent has been obtained, or unless the communication is otherwise permitted by law.
Commercial electronic messages are sent in accordance with Canada’s Anti-Spam Legislation (“CASL”), where applicable. Such messages will contain the identification and contact information required by law and a working unsubscribe mechanism. Unsubscribe requests will be processed without charge and within the period required by law, which is generally no later than ten business days after receipt.
We use MailerLite to administer email subscriptions and distributions. MailerLite may process email addresses, names, subscription status, delivery information, and engagement information on our behalf. Administrative or transactional communications necessary to respond to an enquiry or deliver a resource requested by you may continue even if you unsubscribe from marketing communications.

9. Cookies and Similar Technologies

Depending on how the Website and its Service Providers are configured, cookies, pixels, local storage, server logs, and similar technologies may be used to provide functionality, protect the Website, measure performance, understand usage, and improve the visitor experience.
Cookies are small data files stored on or accessed through a device. They may be session cookies, which expire when a browser is closed, or persistent cookies, which remain for a defined period. Technologies used in connection with the Website may include:

11. Website Hosting, Security, Content Delivery, and Downloads

The Website is created and published using Carrd and uses Cloudflare services for domain-related functions, security, performance, content delivery, and related infrastructure. Cloudflare services, including content-delivery or object-storage services used to deliver downloadable resources, may process technical information such as Internet Protocol addresses, request data, security events, network information, and diagnostic data.
Carrd, Cloudflare, and related infrastructure providers process information in accordance with their own privacy practices and the services they provide. Technical information may be processed in multiple jurisdictions as necessary to operate global networks and deliver content efficiently.

12. Service Providers

We may use Service Providers to perform functions on our behalf, including Website publishing, hosting, content delivery, domain services, email distribution, analytics, file storage, security, and related technology services. Current or potential Service Providers include Carrd, Cloudflare, MailerLite, Google, and other vendors reasonably necessary to operate the Website.
Service Providers are given access only to information reasonably necessary to perform their services. We remain accountable for Personal Information transferred to a Service Provider for processing, subject to applicable law, and seek to use contractual, technical, or organizational measures appropriate to the circumstances.
Service Providers may update their products, locations, subprocessors, or privacy practices. This Privacy Policy may be updated when material changes affect how Personal Information is handled.

13. Amazon and External Websites

The Website contains links to Amazon websites where Memory Care Puzzle Books may be purchased. When you select an Amazon link, you leave the Website and interact directly with Amazon. Amazon independently controls its collection and use of information relating to browsing, accounts, orders, payment, shipping, returns, and customer service.
The Memory Care Pharmacist does not process or store payment-card information for Amazon purchases and is not responsible for Amazon’s privacy, accessibility, security, or commercial practices.
The Website may also link to government agencies, health organizations, social-media platforms, or other third-party resources. External links are provided for convenience or informational purposes and do not make us responsible for the privacy practices, content, availability, or security of those third parties. Visitors should review the applicable third-party privacy policies before providing Personal Information.

14. Disclosure of Personal Information

We do not sell or rent Personal Information. We do not disclose Personal Information to unrelated third parties for their own direct-marketing purposes, except with consent or as otherwise permitted or required by law.
Personal Information may be disclosed in the following circumstances:
• to Service Providers that process information or perform services on our behalf;
• with your direction or consent;
• to comply with a subpoena, court order, warrant, regulatory requirement, or other lawful process;
• where reasonably necessary to detect, investigate, prevent, or respond to fraud, abuse, security incidents, or unlawful conduct;
• to protect the rights, safety, or property of The Memory Care Pharmacist, Website visitors, or others;
• to establish, exercise, or defend legal claims; or
• in connection with a proposed or completed sale, transfer, reorganization, financing, or other transaction involving all or part of the business, subject to applicable legal requirements.

15. De-identified and Aggregated Information

We may use information that has been aggregated, anonymized, or de-identified so that it no longer identifies an individual, for purposes such as evaluating Website use, improving educational resources, planning content, and understanding general audience interests. We will not attempt to re-identify information that has been de-identified, except where permitted by law for security, testing, or validation purposes.

16. Processing Outside Canada

Some Service Providers operate or store information outside Canada. Personal Information may therefore be transferred to, stored in, or processed in the United States, the European Economic Area, or other jurisdictions in which Service Providers or their subprocessors operate.
When Personal Information is processed outside Canada, it may be subject to the laws of the foreign jurisdiction and may be accessible to courts, law-enforcement agencies, national-security authorities, or regulators in accordance with those laws. Where appropriate, we seek to use contractual or other measures designed to require Service Providers to protect Personal Information in a manner comparable to the protection required under applicable Canadian privacy law.
You may contact the Privacy Officer for information about Service Providers that process Personal Information outside Canada, subject to legal and security limitations.

17. Security Safeguards

We use reasonable administrative, technical, and organizational safeguards designed to protect Personal Information against loss, theft, unauthorized access, disclosure, copying, use, modification, or destruction. The nature of the safeguards used depends on factors such as the sensitivity, amount, format, location, and intended use of the information.
Safeguards may include access controls, strong authentication practices, encrypted transmission where supported, security monitoring, reputable Service Providers, software updates, backups, and procedures intended to limit access to persons or providers with a legitimate need.
No method of transmission over the Internet or electronic storage is completely secure. Accordingly, we cannot guarantee absolute security. You should use caution when sending sensitive information by ordinary email or through online forms.

18. Privacy Breaches

We maintain procedures intended to identify, assess, contain, investigate, and respond to suspected privacy or security incidents. Where a breach of security safeguards creates a real risk of significant harm or otherwise meets a reporting or notification threshold under applicable law, we will take the steps required by law, which may include notifying affected individuals and the appropriate privacy regulator and maintaining prescribed records.

19. Retention and Disposal

Personal Information is retained only for as long as reasonably necessary to fulfil the identified purposes, meet legal and regulatory requirements, resolve disputes, enforce agreements, maintain appropriate business records, and honour consent or unsubscribe choices.
Retention periods vary according to the type of information and the circumstances. For example:
• subscription information may be retained while a subscription remains active;
• limited suppression-list information may be retained after an unsubscribe request to ensure that the request continues to be honoured;
• enquiry correspondence may be retained for a reasonable period to address follow-up questions or document the response;
• technical and analytics information may be retained in accordance with configured retention settings and provider practices; and
• records required for legal, compliance, security, or dispute-resolution purposes may be retained for the applicable period.
When Personal Information is no longer required, we take reasonable steps to delete, destroy, anonymize, or otherwise dispose of it securely, subject to technical limitations such as backup cycles and legal obligations.

20. Accuracy

We make reasonable efforts to ensure that Personal Information used to provide a requested service or communication is accurate, complete, and current to the extent necessary for the purpose. You are responsible for providing accurate information and for notifying us when information such as an email address or communication preference changes.

21. Access and Correction Requests

Subject to applicable law, you may request information about the existence, use, and disclosure of your Personal Information and may request access to Personal Information under our control. You may also request correction of information that is inaccurate or incomplete.
A request should be submitted in writing to the Privacy Officer. We may require sufficient information to verify identity and locate the requested records. Access may be refused or limited where permitted or required by law, including where disclosure would reveal Personal Information about another individual, confidential commercial information, information protected by legal privilege, or information that cannot lawfully be disclosed.
If access is refused, we will explain the reason and available recourse to the extent required by law. Requests will be addressed within the time and at the cost, if any, permitted by applicable law.

22. Withdrawal of Consent, Unsubscribing, and Deletion Requests

You may withdraw consent to future collection, use, or disclosure of Personal Information, subject to legal or contractual restrictions and reasonable notice. You may unsubscribe from marketing communications by using the unsubscribe link in an email or by contacting us directly.
You may request deletion of Personal Information, where appropriate. A deletion request may be declined or limited where retention is required or permitted by law, reasonably necessary to complete a transaction or respond to an enquiry, required to honour an unsubscribe request, or necessary for security, legal, regulatory, or recordkeeping purposes.
Withdrawal of consent does not affect the lawfulness of processing that occurred before withdrawal.

23. Children and Young Persons

The Website is intended primarily for adults and is not directed to children under thirteen years of age. We do not knowingly seek Personal Information from children under thirteen without the consent of a parent or legal guardian, except where otherwise permitted by law.
If we learn that Personal Information relating to a child was collected in circumstances where valid consent was required but not obtained, we will take reasonable steps to delete or otherwise address the information. A parent or legal guardian who believes that a child has provided Personal Information may contact the Privacy Officer.

24. Communications and Electronic Transmission Risks

Email and Internet communications may not be secure. Messages can be delayed, misdirected, intercepted, or accessed without authorization. Please avoid sending sensitive health, financial, or identity information by ordinary email. If an enquiry requires the exchange of sensitive information, contact us first to determine whether an alternative method is available.

25. Changes to this Privacy Policy

We may amend this Privacy Policy to reflect changes in law, technology, Service Providers, Website functionality, business practices, or information-handling activities. The “Last Updated” date at the beginning of the Policy will be revised when changes are published.
Where a material change requires new consent, we will seek that consent in an appropriate manner before the new collection, use, or disclosure takes place. Otherwise, the updated Privacy Policy will apply from the stated effective date. We encourage visitors to review this Privacy Policy periodically.

26. Applicable Law

This Privacy Policy is intended to be interpreted in accordance with the privacy and electronic-communications laws applicable to the relevant activity, including PIPEDA and CASL where applicable, and the laws of the Province of Ontario and the federal laws of Canada applicable therein. Nothing in this Privacy Policy limits a right or remedy that cannot lawfully be limited.

Headings are included for convenience and do not limit the meaning of any provision.
This Privacy Policy constitutes the general statement of privacy practices applicable to the Website. Additional just-in-time notices, consent language, or service-specific terms may supplement this Policy. If there is a conflict, the more specific notice will govern the particular collection, use, or disclosure to which it relates, to the extent permitted by law.
